During a brief discussion at Phillips\u2019 Masterpiece Cakeshop in Denver, the baker politely but firmly refused, leaving the couple upset.<\/p>\n<p>They filed a successful complaint with the state civil rights commission, the first step in a six-year legal battle. State courts sided with the couple, prompting Phillips to appeal to the top U.S. court. He has said a backlash against his business has left him struggling to keep his store open.<\/p>\n<p>The justices, in a 7-2 decision, said the Colorado Civil Rights Commission showed an impermissible hostility toward religion when it found that baker Jack Phillips violated the state\u2019s anti-discrimination law by rebuffing gay couple Mullins and Craig in 2012.<\/p>\n<p>The ruling concluded that the commission violated Phillips\u2019 religious rights under the U.S. Constitution\u2019s First Amendment.<\/p>\n<p>But the justices did not issue a definitive ruling on the circumstances under which people can seek exemptions from anti-discrimination laws based on their religious views.<\/p>\n<p>The decision also did not address important claims raised in the case including whether baking a cake is a kind of expressive act protected by the Constitution\u2019s free speech guarantee.<\/p>\n<p>Two of the court\u2019s four liberals, Stephen Breyer and Elena Kagan, joined the five conservative justices in the ruling authored by Justice Anthony Kennedy, who also was the author of the landmark 2015 decision legalizing gay marriage nationwide.<\/p>\n<p>\u201cThe commission\u2019s hostility was inconsistent with the First Amendment\u2019s guarantee that our laws be applied in a manner that is neutral toward religion,\u201d Kennedy wrote.<\/p>\n<p>But Kennedy also stressed the importance of gay rights while noting that litigation on similar issues is likely to continue in lower courts.<\/p>\n<p>\u201cOur society has come to the recognition that gay persons and gay couples cannot be treated as social outcasts or as inferior in dignity and worth,\u201d Kennedy said.<\/p>\n<p>The case became a cultural flashpoint in the United States, underscoring the tensions between gay rights proponents and conservative Christians.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The much-talked-about case raised debate over the right to discriminate  [&#8230;]<\/p>\n","protected":false},"author":21,"featured_media":16807,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[46],"tags":[1089,1088,1090],"class_list":["post-16805","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-innovation-business","tag-david-mullins-and-charlie-craig","tag-gay-wedding-cake-controversy","tag-right-to-discriminate-on-religious-grounds"],"_links":{"self":[{"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/posts\/16805","targetHints":{"allow":["GET"]}}],"collection":[{"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/users\/21"}],"replies":[{"embeddable":true,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/comments?post=16805"}],"version-history":[{"count":2,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/posts\/16805\/revisions"}],"predecessor-version":[{"id":16811,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/posts\/16805\/revisions\/16811"}],"wp:featuredmedia":[{"embeddable":true,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/media\/16807"}],"wp:attachment":[{"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/media?parent=16805"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/categories?post=16805"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/wp-json\/wp\/v2\/tags?post=16805"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
