{"id":23021,"date":"2019-09-27T09:00:05","date_gmt":"2019-09-27T09:00:05","guid":{"rendered":"https:\/\/www.ceo-na.com\/?p=23021"},"modified":"2019-09-27T17:07:18","modified_gmt":"2019-09-27T17:07:18","slug":"call-me-an-employee-not-a-freelancer","status":"publish","type":"post","link":"http:\/\/servidor-mxigen1.com\/ceona-antiguo\/opinion\/call-me-an-employee-not-a-freelancer\/","title":{"rendered":"Call me an employee, not a freelancer"},"content":{"rendered":"<p><i><b>How will California&#8217;s new labor legislation affect employees of ride-sharing firms?<\/b><\/i><!--more--><\/p>\n<p>On Sept. 11,\u00a0California state lawmakers approved a landmark bill, AB5, that will force many firms to classify independent contractors as employees.<\/p>\n<p>California governor, Gavin Newsom, a Democrat, had pushed hard for the change.<\/p>\n<p>As he argued in a Labour Day op-ed in the Sacramento Bee, firms must no longer be allowed to \u201cshirk responsibility\u201d and should cough up for things like medical benefits, unemployment insurance, and paid sick days.<\/p>\n<p>The bill\u2019s sponsor, Democratic assemblywoman Lorena Gonz\u00e1lez, has argued the legislation\u00a0will help workers, \u201cnot Wall Street and their get-rich-quick IPOs.\u201d<\/p>\n<p>Whether that is true or not is fiercely debated. Firms that rely heavily on contract workers argue that a requirement to treat them as employees will put many out of work. The bill\u2019s authors seemingly admitted as much, inserting dozens of exemptions for certain types of\u00a0workers, including accountants, architects, dentists, doctors, engineers, and estate agents.<\/p>\n<p>Missing from the exemptions, however, are drivers for ride-sharing firms like Uber and Lyft. The bill\u2019s authors argue that the ride-sharing platforms impose rules on their drivers which mean that they are not truly self-employed.<\/p>\n<p>Only \u201ca small fraction\u201d of Lyft\u2019s roughly 325,000 drivers in California will keep working if the law takes effect as expected on January 1, says Adrian Durbin, head of policy communications for the San Francisco-based firm. Some experts reckon ride fares could rise by as much as 30%. Demand for trips could therefore slip. Beyond that, Lyft drivers will lose the ability to work, or not work, whenever they want, Durbin notes.<\/p>\n<p>Unions such as the\u00a0Teamsters pressed hard for the legislation, which promises to make recruiting members easier. One big backer of the bill, the Service Employees International Union, reckons other states will follow suit.<\/p>\n<p>A day before the bill passed, New York\u2019s governor, Andrew Cuomo, a Democrat, lauded California\u2019s push and said it got his \u201ccompetitive juices flowing.\u201d Democrats running for president who have endorsed California\u2019s bill include front-runners such as Kamala Harris, Bernie Sanders, and Elizabeth Warren.<\/p>\n<p>Lyft and Uber have lost roughly a third of their stock\u00a0market values since July but both are gearing up for battle. The firms now hope to strike an alternative deal with unions and lawmakers by offering drivers certain benefits including reimbursement for some expenses and guaranteed earnings that exceed the minimum wage.<\/p>\n<p>Should that fail, Uber, for its part, reckons it may still manage to keep its drivers as contractors. In a conference call following the bill\u2019s passage, Uber\u2019s top lawyer, Tony West, said the idea is to argue in court that its main business is being a technology platform. That distinction could waive the requirement to treat drivers as employees.<\/p>\n<p>A final option, both firms say, is to gather petition signatures to kick-start a ballot initiative that would sidestep California\u2019s lawmakers.
